Effective: July 28, 2026
These Terms govern your use of the Calorithm iOS app. Calorithm estimates the nutrition content of meals you photograph and keeps a log for you. It is a tracking tool, not a medical, dietary, or nutritional advice service, and its estimates can be wrong. We do not require you to create an account. Connecting Apple Health is optional and you control it. Anything you post to the community feed is public. You can delete the app at any time.
By accessing or using the Calorithm iOS app and related in-app services (the "Service"), you agree to these Terms of Use ("Terms") and our Privacy Policy, which is incorporated by reference.
These Terms constitute a binding agreement between you and NUNE LLC ("we," "us," "our," or "Calorithm"), a Wyoming limited liability company.
You must be at least 18 years old, or the age of majority in your jurisdiction, whichever is higher, to use the Service. By using Calorithm, you represent that you meet this requirement and have legal capacity to agree to these Terms.
If you downloaded Calorithm from the Apple App Store, Apple's Licensed Application End User License Agreement applies to your use of the app. These Terms supplement Apple's terms. Apple is not responsible for the Service, its content, maintenance, support, warranties, claims, or legal compliance, except as required by Apple's applicable terms.
Calorithm analyzes photos of meals you submit and returns an estimated identification of the food and its nutrition values, which you can review, edit, and log.
Calorithm is a self-tracking tool. It is not a medical device, and it does not provide medical, nutritional, dietary, clinical, or fitness advice, diagnosis, or treatment. Nothing in the Service is a recommendation about what you should eat, how much you should eat, or what your health goals should be. Any target or figure you enter is a value you chose, not advice from us.
Nutrition estimates are generated by AI from a photograph and are approximations only. They may be inaccurate, incomplete, or wrong about the food itself, its ingredients, its portion size, or its allergen content. Do not rely on the Service for any decision where accuracy matters to your health or safety, including allergy, intolerance, medication, or medical dietary requirements.
Always consult a qualified healthcare professional before making changes to your diet, and before using any tracking tool if you have a medical condition, are pregnant, or have a history of disordered eating. If you are struggling with your relationship to food, please seek support from a qualified professional.
To provide the Service, Calorithm processes the photos you choose to submit. By submitting a meal photo for analysis, you authorize Calorithm and its service providers to transmit, process, temporarily cache, and return the photo and resulting analysis as needed to provide the requested estimate, secure the Service, troubleshoot errors, prevent abuse, and comply with law.
We do not intentionally retain your submitted photos beyond what is needed to provide the Service and maintain your log. Photos or related technical data may be temporarily retained by our service providers according to their security, processing, abuse-prevention, and legal compliance practices. We do not authorize our AI provider to use your photos to train its models.
Connecting Apple Health is optional. If you enable it, you authorize Calorithm to write nutrition entries you log and to read only the data types you specifically permit, as described in our Privacy Policy. You control every Health permission and can revoke access at any time in iOS Settings under Privacy & Security → Health.
We do not use Apple Health data for advertising or marketing, do not sell it, and do not share it with our AI, analytics, or attribution providers. Data written to Apple Health is stored and controlled by Apple; to remove it, delete it in the Health app.
You retain ownership of photos and other content you submit to Calorithm. You grant Calorithm a limited, worldwide, non-exclusive, royalty-free license to host, transmit, process, modify, store, and display your submitted content solely to operate, secure, improve, and provide the Service to you.
You are responsible for ensuring you have the necessary rights and permissions to submit content to the Service. Do not submit photos you do not own or have permission to use.
AI outputs may be inaccurate, incomplete, or unexpected. You are responsible for reviewing and correcting outputs before relying on them. You may use outputs for lawful personal purposes, subject to these Terms and applicable law.
The Service includes an optional community area. Anything you post there — including photos, captions, display name, and avatar — is public and visible to other users. Do not post anything you would not want to be public, and do not post images of other people without their consent.
By posting, you grant Calorithm a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content within the Service for as long as you keep it posted, and to retain limited copies afterwards in backups and logs.
You are solely responsible for what you post. We may remove content, restrict features, or suspend access at our discretion, including for content that violates these Terms. We do not pre-screen community content and do not endorse it. Content posted by other users is theirs, not advice from us.
You may not use the Service to:
The Service relies on third-party services, including AI processing, cloud infrastructure and storage, analytics, attribution, and payment providers. Their terms and privacy practices may apply to their services. We are not responsible for third-party services except to the extent required by law.
Some features may require a paid subscription. Subscription options, including title, duration, price, renewal terms, and included features, are shown before purchase in Apple's in-app purchase flow.
If you purchase through Apple, payment will be charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current subscription period. Your Apple ID may be charged for renewal within 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple ID settings. Refunds, billing, and cancellation are handled by Apple, except where applicable law requires otherwise.
If you believe content processed through or associated with the Service infringes your rights, contact us at contact@nunellc.com with enough information for us to review the issue, including your name, contact information, a description of the rights at issue, and the allegedly infringing material.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including any warranty of accuracy, fitness for a particular purpose, or suitability for any health or dietary need. To the maximum extent permitted by law, Calorithm is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, use, goodwill, or other intangible losses, including any loss or harm arising from reliance on nutrition estimates. Our aggregate liability for all claims related to the Service will not exceed the greater of (A) amounts you paid in the six (6) months before the claim, or (B) USD $50.
We may update these Terms from time to time. If changes are material, we will notify you by reasonable means, such as through the app or by updating the effective date. Your continued use of the Service after changes take effect means you accept the updated Terms.
Export & sanctions: Do not use the Service in violation of export control or sanctions laws.
Governing Law: These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and Calorithm for the Service.
